Agents – agency law

Agent – agency relationships are extremely common now and the main things, in commercial and legal terms you need to be aware of are :-

  1. The boundaries of authority – make it clear both to the agent and anyone that the agent may deal with on your behalf whenever possible as to the agent’s authority to agree things. If this is not made clear there may be arguments or even litigation about actual or ostensible authority
  2. Be aware of the Commercial Agent Regulations – these arise from European law and can easily catch pout the unwary. They provide for compensation, sometimes considerable, to be paid to an agent when his/her or it’s contract is terminated
  3. Employment law – whilst in theory an agent is self emp0loyede and this can be one of the main reasons for using an agent, due to the flexibility, it is possible that the relationship may develop into an employment relationship. The label of the relationship is not decisive in employment law terms.
